Terms & Conditions
These following terms apply to all offers, agreements, services and legal commitments between you and the Daguerreobase – the Daguerreobase being a program which falls under the liability of the Nederlands Fotomuseum, Rotterdam, the Netherlands. These terms will be enforced unless there is a written understanding between both parties to deviate from them. By using the Daguerreobase as a registered member, whether membership is free or paid for, the user agrees to these terms.


1. Description of service

The Daguerreobase provides members with the ability to add and edit records describing the features of daguerreotypes and upload images (JPEG, not exceeding 2000 x 2000 pixels) of these daguerreotypes. Additionally, members can add and edit information about collections, owners, plate manufacturers and daguerreotype creators.

Members with an “Individual” or “Institution” account can add an unlimited amount of records and browse restricted information. Members with and “Institution” account can manage a maximum of twenty (20) user accounts.


2. Rights and indemnities

2.1 Moderation
The Daguerreobase staff expressly reserves the right to immediately modify content, delete content from, suspend or terminate your account and refuse current or future use of Daguerreobase services, if the Daguerreobase staff in its sole discretion believes you have:
-acted inconsistently with the spirit or letter of the Terms and Conditions;
-acted inconsistently with the spirit or letter of Dutch law;
-acted in a way that is offensive to any other user of the Daguerreobase;
-acted in a way that incriminates or undermines the Daguerreobase’s functioning and accuracy.
In such a case your Daguerreobase account may be suspended or cancelled immediately, all the information and content contained within it deleted permanently and you will not be entitled to any refund of any of the amounts you’ve paid for such account. The Nederlands Fotomuseum accepts no liability for information or content that is deleted.
2.2 Copyright infringement
The Nederlands Fotomuseum cannot be held accountable for infringement of copyright by users or visitors of the Daguerreobase. By accepting these terms, you are agreeing that responsibility for publishing content, as well as acquiring the appropriate legal permissions, lies with you.
2.3 Unforeseeable circumstances
The Nederlands Fotomuseum reserves the right to, in case of unforeseeable circumstances, suspend made agreements, or terminate them without judicial interference. Unforeseeable circumstances include any shortcoming the Nederlands Fotomuseum cannot reasonably of lawfully be held accountable for.
2.4 Applicable jurisdiction
The Daguerreobase Terms and Conditions provides that both you and the Nederlands Fotomuseum, which is responsible for the Daguerreobase, agree to submit to the personal and exclusive jurisdiction of the courts located in Rotterdam, the Netherlands.
